Terms & Conditions of the Sale of Real Estate

Sale Day Announcements take precedence over any previous statements made or advertisements.

AGENCY DISCLOSURE:  The Auctioneer, James A. “Jim” Graves (Middle Tennessee Realty & Auction, LLC) is conducting this auction and representing the Seller’s only.   


ESCROW/TRUST DEPOSIT:  Confirmed Winning Bidders are Required to pay a Ten (10) percent escrow Trust deposit on sale day and execute the purchase agreement and other documents.  The Escrow/Trust deposit shall be deposited into the Trust Account of Middle Tennessee Realty & Auction, LLC for bank clearance and then deposited with the Closing Attorney as credit towards the purchase price.  Closing and transfer of title shall take place on or before July 10th, 2017 unless Auctioneer extends the closing date to facilitate closing.

REAL ESTATE SELLING SUBJECT TO All governmental rules and regulations or County Zoning Laws.   Also, subject to all public utility and private easements, right-of-ways, and encroachments, if any, shown of record, as well as those found upon inspection of the premises.

CLOSING COST:  Buyer(s) will pay their attorney’s closing fees, recording of Warranty Deed and any potential Mortgage Instruments, title update or title insurance if ordered and any cost related to the acquisition of a purchase money mortgage.  Seller(s) have paid the cost of a Title Search for the Auctioneer’s purpose to prove Clear Title, are furnishing Existing plats and public records, Warranty Deed, their Attorney’s Closing Fee, Brokerage Commission & pro-rated taxes.                                                                                                                                                                           

THE CLOSING ATTORNEY WILL BE:  The Spitzer Firm, Hohenwald, TN located at 19 Cedar Street, Hohenwald, TN  38462.

REAL ESTATE TAXES & ASSESSMENTS: 2017 Real Estate Taxes and assessments will be prorated to closing date.

RELATED DOCUMENTS:    Additional Documents related to the Real Estate have been displayed on the Firm Internet Site, available in Bid Packets and are posted on the Info board.                                                                                                                                                                                                                                                                                                                                     HAZARD LOSS: Seller will bear hazard loss insurance until date of closing.

SEPTIC & WATER:   Available Septic and Well Records have been obtained from the State Health Department and supplied as a part of the Bidding Information Packet.

UTILITIES:  House has Well Water, Septic System, Central Electric Heat & Cool, fireplace & wood heater in basement.  The Mobile Home has Well Water, Septic System, central Heat & air.

POSSESSION:  Possession shall be granted on the date of Closing and Transfer of Purchase Funds.                                               

ORDER OF SALE    Tract# 1 – (House Tract) will be offered in whole dollars and “POSTED”.

                                     Tract # 2 – (70 acres Tract) will be offered first in “per acre bids” and  “POSTED”.

                                 Tract # 3 – (56.3 acres Tract) will be offered in “per acre bids” and “POSTED”.

                                          Tract # 4 – (Mobile Home Tract) will be offered in “whole dollars” and “POSTED”.

            All high bids will then be presented to the Sellers for confirmation.

NOTE:  This pre-sale “order of sale” is subject to possible change on sale day.         

BIDDING:  Anyone in attendance at the Auction is permitted to bid, if legally qualified, and if prepared to purchase, execute a purchase contract and place the required Escrow/Trust Deposit.  All Bidders must be registered, provide proof of Identification and obtain bidder’s card!

The Auctioneer reserves the right to accept or reject any bid based on the increments.  The Auctioneer also reserves the right to refuse bids from anyone who is not properly registered or, in the opinion of the Auctioneer not lawful to bid, or under the influence of any substance or acting in any manner detrimental to the Sellers’ interest.  Auctioneers reserve the right to settle any disputes or misunderstandings in regards to the bidding.

TERMS and CONDITIONS: ALL ITEMS offered in “AS-IS” and “Where Is” Condition.  No Warranties or Guarantees of any type are Expressed or Implied by the Seller(s) or Auction Company.  The Auctioneers are not responsible for any statements made by the Sellers or other parties.

SETTLEMENT:  Full Cash payment or Good Check paid to the Cashier today before removing or loading any items. NO SALES TAX AND NO BUYER’S PREMIUM!  All small items must be removed on day of sale.  In addition, neither the Sellers, the Auctioneer, or the Auction Firm, shall not be responsible for the security of any items on the property. Winning Bidders shall assume full responsibility for items purchased immediately upon being declared the winning bidder.

All Bidders must be registered for the Auction, provide proof of Age & Identification and obtain bidder’s card!

 ITEMS REQUIRING STATE ISSUED TITLE OR BILLS OF SALE:  In the event Buyers pay for Vehicles requiring Titles and Bills of Sales with a check, the Titles will be held by the Auctioneer until the check has cleared bank processing.  If you pay in cash, the Titles are available today. 

LOADING ASSISTANCE:  The Auction Team can assist with loading large items after the Auction concludes, but will not be responsible for any damages incurred.
